Payment: We may use and disclose your PHI to bill and collect payment for services provided. This may include disclosure to your health insurance company, third-party payers, or collection agencies if necessary.

Example: We may submit claims to your insurance company that include diagnosis codes, treatment dates, and provider information to obtain payment for services rendered. We may send billing reminders via SMS/MMS.

  • Transcription services

  • Legal and accounting consultants

All Business Associates are contractually required to:

  • Use appropriate safeguards to protect your PHI

  • Use and disclose your PHI only as permitted by their BAA or as required by law

  • Report any breaches of unsecured PHI to our practice

  • Ensure their subcontractors comply with the same privacy and security requirements

Other Permitted and Required Uses and Disclosures

We may use or disclose your PHI without your authorization for the following purposes:

Required by Law: When federal, state, or local law requires disclosure.

Public Health Activities: To report disease, injury, vital events, or public health surveillance to public health authorities.

Victims of Abuse, Neglect, or Domestic Violence: When we believe you are a victim of abuse, neglect, or domestic violence, we may disclose your PHI to government authorities authorized to receive such information.

SMS/MMS Communications: While appointment reminders and account notifications may be sent via SMS/MMS as part of treatment and healthcare operations, any marketing messages sent via SMS/MMS require separate express written consent.

Other Uses: Other uses and disclosures not described in this Notice will be made only with your written authorization.

Right to Revoke Authorization: You may revoke any authorization you have given us in writing at any time, except to the extent we have already taken action in reliance on your authorization. To revoke an authorization (including SMS/MMS consent), please submit your written request to our Privacy Officer at the address listed below or reply STOP to any SMS/MMS message.

Your Rights Regarding Your Protected Health Information

Right to Request Restrictions: You have the right to request restrictions on how we use or disclose your PHI for treatment, payment, or healthcare operations. You may also request limits on disclosures to individuals involved in your care, including requesting that appointment reminders not be sent via SMS/MMS. We are not required to agree to your request but will consider it carefully. If we agree, we will comply with your request unless the information is needed for emergency treatment.

Special Rule: We must agree to your request if you ask us not to disclose PHI to your health plan for payment or healthcare operations purposes when you have paid for the service in full out-of-pocket.

Right to Receive Confidential Communications: You may request that we communicate with you about your PHI by alternative means or at alternative locations. For example, you may request that we contact you only at your work phone number, by mail, or via secure patient portal instead of SMS/MMS. We will accommodate reasonable requests.

Right to Inspect and Copy: You have the right to inspect and obtain a copy of your PHI contained in your medical record and billing records, including SMS/MMS message logs that are part of your medical record. To inspect or copy your PHI, submit a written request to our Privacy Officer. We may charge a reasonable fee for copying and mailing your records.

We may deny your request in certain limited circumstances. If we deny your request, you may request that the denial be reviewed.

Right to Amend: If you believe that information in your medical record is incorrect or incomplete, you may request that we amend it. Submit your request in writing to our Privacy Officer and include the reason for your request.

We may deny your request if:

  • The information was not created by us

  • The information is not part of the records we maintain

  • The information is not available for inspection

  • The information is accurate and complete

If we deny your request, you may submit a written statement of disagreement.

Right to an Accounting of Disclosures: You have the right to request an accounting of certain disclosures of your PHI made by us during the six years prior to your request (or a shorter period if you specify). This accounting will not include disclosures for treatment, payment, or healthcare operations, disclosures made to you, disclosures authorized by you, or routine SMS/MMS appointment reminders.

To request an accounting, submit your request in writing to our Privacy Officer. The first accounting in a 12-month period is free; we may charge a reasonable fee for additional requests.

Right to a Paper Copy of This Notice: You have the right to receive a paper copy of this Notice at any time, even if you have agreed to receive it electronically. You may obtain a copy by contacting our Privacy Officer or downloading it from our website.

Right to Be Notified of a Breach: You have the right to be notified in the event that we (or one of our Business Associates) discover a breach of your unsecured PHI, including breaches involving SMS/MMS communications.
